Halinaha operates the Halinaha.com website and Halinaha Android app available in Google Play Store, which provides the Hyper-local delivery service in Kokrajhar. This page is used to inform Halinaha App users regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Service, the Halinaha App. If you choose to use our Service, then you agree to the collection and use of information about this policy. The Personal Information that we collect is used for providing the Service. We will not use or share your information with anyone except as described in this Privacy Policy.


Our Services
Halinaha is an online delivery platform designed to connect our Customers (You) directly to our partners (Vendor and/or Independent) listed in the Halinaha Platform. We do not prepare or sell any of the items listed on the Halinaha Platform. Our software application (available in Android) enables you to see the list of our partner restaurants, browse the items and select it for delivery. As a software platform provider, Halinaha does not guarantee the quality of the food and/or other items offered in any of the Partner's menus. We have not verified nor will we be held responsible for any health or preparation claims declared by our partners.


Online Ordering
• Halinaha provides online ordering services by entering into contractual arrangements with vendor partners (“Retail Stores”) and independent partners as explained in Section-III (Types of Partners) on a principal-to-principal basis to list their items/units or the products for online ordering by the Customers on the Halinaha App.
• The Customers are registered and can access the items or products listed on the Halinaha app and place online orders against the Vendor or Independent Partners.
• Delivery of an order placed by a customer through the Halinaha app may be undertaken directly by the Vendor or Independent Partner, or directly facilitated by Halinaha through a third party who may be available to provide delivery services to you for your order being placed on Halinaha. In both cases, Halinaha is merely acting as an intermediary between you and the delivery partners.
• Customers may be charged a delivery fee for delivery of your order by the Delivery partner (as stated above in point 3). You (Customer) agree that Halinaha is authorized to collect, on behalf of the Vendor or Independent Partners, the delivery charges for the delivery service provided by the Vendor or Independent Partner or the Delivery partner, as the case may be. The delivery charge may vary from order to order, which may be determined by multiple factors which shall include but not be limited to Vendor/Independent Partner, order value, distance, time of the day. Halinaha will inform you of the delivery charges that may apply to you, provided you will be responsible for delivery charges incurred for your order placed at Halinaha regardless of your awareness of such Delivery Charges.


Types of suppliers


1. Vendor Partners
o Retail stores that list their items (groceries, essentials, etc.) on the Halinaha app
o Pharmaceutical stores that list their items (medicines) on the Halinaha app
2. Independent Partners
o Individual or group sellers that list their item (eatable and non-eatable) on the Halinaha app.


Refund & Cancellation Refund
• Customer(s) shall be entitled to a refund only if the customers make the payment (Online through Net Banking or Credit/Debit Card or UPI) at the time of placing an order on the Halinaha app and/or only in the event of any of the following circumstances-
• Order Packaging has been tampered with or damaged at the time of delivery.
• Items are missing from your order list upon checking at the time of delivery.
• Customer delivery location falling outside Halinaha’s designated delivery zones.
• Failure to contact Customer by phone at the time of confirming the order.
• Orders can be cancelled only during pending state. Once the order has been moved to preparing the order can not be cancelled. Order cancellation by Customer at the time of confirming due to unavailability of the items, which Customer ordered at the time of booking. Customers found to be deliberately trying to create orders and not accept may be reported to local police station and FIR can be registered.
• Customer(s) decision on refunds shall be at our sole discretion and shall be final and binding.
• All refunded amounts shall be credited to Customer(s) account within 10-14 business days by the terms that may be stipulated by the bank which has issued the credit/debit card.
• In case of Cash on Delivery Payment mode at the time of delivery, Customer will not be required to pay for-
• Orders where the packaging has been tampered with or damaged at the time of delivery.
• Wrong order being delivered.
• Items missing from the order at the time of delivery. Please note that the items should be checked at the time of delivery. Once the order is being received by the Customer, no return or refund will be entertained.


Cancellation
• Customers may have the option to cancel an order(s), provided the order(s) are placed by them through their registered account in the Halinaha app.
• Upon clicking “Place Order” in the Halinaha app, Customer (You) have the right to cancel the order as long as it is not accepted by the Vendor or the Independent Partners. Once the order gets accepted by the Vendor or Independent Partners and the same status (“Order Accepted”) displays in the app, the Customer (You) will not be able to cancel the order.
• In an unlikely event of an item on Customers (You) order being unavailable, the Halinaha team will contact Customer (You) on your provided contact details at the time of placing an order and inform Customer (You) of such unavailability. In such an event Customer (You) have the sole rights to cancel the entire order and shall be entitled to a refund by our refund policy, provided you were charged for the items.
• We reserve the sole right to cancel Customers order in the event of any of the following circumstances-
• Failure to contact you by phone at the time of confirming the order booking.
• Unavailability of all the items ordered by Customer at the time of placing the order.
• If the provided address at the time of placing an order falls outside the delivery zone offered by us.
• Failure to deliver your order due to lack of information, direction, or authorization from you at the time of delivery.
• In an unlikely event caused due to new laws & regulations implemented, natural hazards, and other external factors.


Delivery of Customer(s) order
Halinaha delivery partners will try their best to deliver Customer(s) orders within the stipulated timeframe in the app, however, please note that delivery time may vary due to unavoidable external factors.


Returning of Customer(s) Order
Customers have the option to cancel an order if items in the order are found missing or damaged at the time of delivery. In such circumstances, if any dispute arises from the Customer (You) order, it must be settled solely between Customer (You), Halinaha, and our Partners.


Customers Responsibilities
By agreeing to use the Halinaha Platform and by providing us with your details, you are considered a “member” or “customer” of Halinaha. While we will do everything possible to ensure that your use of our services is as smooth as possible, you are also responsible for the following:
• Reading, understanding, and agreeing to the contents of this agreement.
• Ensuring and maintaining the accuracy of your data, including your contact details and delivery address.
• Ensuring that the items ordered from our Partners meet your standards such as dietary and/or religious preferences.
• Reviews, feedback, and comment provided by you to us and our Partners.


Payment Policy
An agreement of payment is automatically made between Customer (You), Halinaha, and our Partner(s) upon placing your order and its successful acceptance. This is validated through a confirmatory message that the Customer (You) will receive. Upon successful order placement, our Partner has full responsibility for preparing the Customer (You) order. Halinaha does not charge any amount for the use of our app. Payments may be made either online or through Cash on Delivery (COD) mode to the delivery partner assigned by Halinaha. Please note that Cash on Delivery will be available for Customer(s) only till 18:00 hrs daily.


Ownership of Licences, IP, and Copyrights
We are the sole and exclusive copyright owners of the Services and our content. Halinaha grants our Customer and Partners permission to view, access, share, and download materials that are part of our platform according to the terms and conditions of this agreement, solely for your own personal and non-commercial use. The materials comprising the platform, including all articles, images, text, logos, source code, audio, and video are owned by or licensed to us. These materials are protected by intellectual property rights under the laws of our country.
You abide by to not use any techniques to enclose any trademark or logo or other proprietary information of Halinaha. If any infringement is found, shall lead to appropriate legal proceedings against you under applicable laws of the country.


Data Privacy
Halinaha will collect and store Customer(s) personal data upon Customer(s) agreeing to the terms and conditions. The data collected may be used to understand the market behavior to improve and enhance the overall experience of our Customers while using the platform. The data provided will also be shared with our registered Partners which will allow us to process your orders. Please note that at any given time you have the right to update, correct, or delete your data.


Policy Update
Halinaha reserves the right to modify and update the privacy policy, terms and services at any given time without any prior notice. This may or may not be because of changes in laws and regulations of the territory, state, or country.


Languages
Halinaha platform is available in both English and Bodo language. However, the privacy policy is primarily issued only in English.
Information Collection and Use For a better experience while using our Service, we may require you to provide us with certain personally identifiable information, including but not limited to your name, phone number, and postal address. The information that we collect will be used to contact or identify you. Log Data We want to inform you that whenever you visit our Service, we collect information that your browser sends to us which is called Log Data. This Log Data may include information such as your computer’s Internet Protocol ("IP") address, browser version, pages of our Service that you visit, the time and date of your visit, the time spent on those pages, and other statistics.
